2. About Moka Mobile

Moka Mobile LLC develops and operates a portfolio of mobile applications and related online services.

Because our applications serve different purposes, some features, functionality, or additional terms may apply only to specific applications.

If a particular application includes supplemental terms, those terms will control in the event of a conflict with these Terms.

3. Eligibility

Our Services are intended only for users who are 18 years of age or older.

By using the Services, you represent and warrant that you are at least 18 years old.

If we determine that a user is under 18, we may suspend or terminate access without notice.

4. User Accounts

Some Services allow users to create an account, while others may be used without registration.

If you create an account, you agree to:

6. Artificial Intelligence Features

You acknowledge that:

  • AI responses are provided for informational purposes.
  • AI output should not be relied upon as professional advice.
  • You remain responsible for decisions made using AI-generated content.
  • We may modify or discontinue AI features at any time.

7. Purchases and Subscriptions

Some applications may offer subscriptions or in-app purchases.

All purchases are processed exclusively through Apple's App Store.

Billing, refunds, cancellations, subscription management, and payment processing are governed by Apple's policies.

Moka Mobile does not directly process or store payment card information.

8. Intellectual Property

All software, applications, graphics, logos, trademarks, branding, content, source code, designs, text, and other materials made available through the Services are owned by or licensed to Moka Mobile LLC.

These materials are protected by United States and international intellectual property laws.

These Terms do not grant ownership of any intellectual property.

You receive only a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, lawful purposes.

9. User Content

If you submit information, suggestions, feedback, bug reports, support requests, or other content, you grant Moka Mobile a worldwide, non-exclusive, royalty-free license to use that information for operating, improving, and supporting the Services.

You represent that you have the necessary rights to submit such content.

10. SMS Communications

Certain Services allow users to voluntarily opt in to receive SMS text messages.

By providing your mobile phone number and opting in, you consent to receive text messages relating to:

  • Account activity
  • Authentication
  • Security notifications
  • Requested updates
  • Service announcements

Message frequency may vary.

Message and data rates may apply.

You may opt out at any time by replying STOP.

Your consent to receive SMS messages is voluntary.

Where applicable, consent to receive text messages is not a condition of purchasing goods or services.

11. Availability

We strive to provide reliable Services but do not guarantee uninterrupted availability.

We may:

  • Modify features
  • Add new functionality
  • Remove functionality
  • Suspend Services
  • Perform maintenance
  • Permanently discontinue applications

without prior notice.

12. Third-Party Services

Our Services may integrate with or rely upon third-party providers, including cloud infrastructure, analytics, messaging services, subscription management platforms, artificial intelligence providers, and other technologies.

We are not responsible for third-party products or services.

Your use of those services may also be governed by their own terms and privacy policies.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOKA MOBILE LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED;
  • THE SERVICES WILL BE ERROR-FREE;
  • DEFECTS WILL BE CORRECTED;
  • THE SERVICES WILL MEET YOUR EXPECTATIONS;
  • THE SERVICES WILL ALWAYS BE SECURE OR AVAILABLE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOKA MOBILE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID TO MOKA MOBILE DURING THE PREVIOUS TWELVE (12) MONTHS; OR
  • FIFTY U.S. DOLLARS (US $50).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless Moka Mobile LLC, its officers, employees, contractors, affiliates, licensors, and service providers from any claims, damages, liabilities, losses, expenses, or legal fees arising from:

  • Your use of the Services;
  • Your violation of these Terms;
  • Your violation of applicable law; or
  • Your infringement of another person's rights.

16. Termination

We may suspend or terminate your access to the Services at any time if:

  • You violate these Terms;
  • We suspect fraudulent activity;
  • We are required by law;
  • Continuing to provide the Services would create legal or security risks.

Termination does not limit any other legal remedies available to Moka Mobile.

17. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

Any legal action relating to these Terms shall be brought in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

18. Changes to These Terms

We may update these Terms from time to time.

Updated versions become effective upon posting unless otherwise stated.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

19. Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any application-specific terms, constitute the entire agreement between you and Moka Mobile LLC regarding the Services.
